The maximum penalty for disappearance is death penalty, the ordinance promulgated


The President announced the death penalty as the maximum penalty for disappearance. The Ministry of Law, Justice and Parliamentary Affairs issued the ordinance on the instructions of Sahabuddin.

The ordinance was gazetted on Monday night. The gazette issued clearly outlines the laws and regulations regarding the nature and punishment of disappearances.

The Ordinance has been issued to prevent disappearances and ensure punishment for heinous crimes like disappearances based on the country's commitment to protect the rights of citizens as a signatory to the International Convention on Disappearances and the right to protection of the individual in the country's constitution, the gazette said.

In the case of disappearance, it is stated that if law enforcement or any other officer or person unlawfully detains, arrests or abducts a person; Concealing missing information or depriving it of legal protection shall constitute a criminal offence. If convicted of such a crime, the offender will face a maximum imprisonment of life or not more than 10 years. At the same time, a fine of 50 lakh rupees will be imposed.

However, according to the explanation of the gazette, if the information of that time is kept secret for the sake of the security of the state until the time of arrest and produced before the magistrate within the prescribed time specified in the law, then it will not be considered as missing.

The death penalty has been announced as the maximum penalty in the case of disappearance. In this case, the gazette said, if a missing person dies or his body is found or if he is not found even after five years of disappearance; Then the convict will be sentenced to death, life imprisonment or any other term. In addition to this penalty, the offender will be fined Tk 1 crore.

According to the gazette, destroying, defacing or altering the sign of disappearance will be punishable by seven years and a fine of Tk 20 lakh.

Any person who constructs, sets up or uses a secret detention center shall be punished with imprisonment not exceeding seven years and with a fine of Tk 20 lakh.

The scope of punishment also includes offenses like fueling, aiding, abetting, abetting. Even if superior officers give such orders or compel their subordinates, they will suffer the same punishment as described in the law.

The International Criminal Tribunal has accepted a number of cases of disappearances. During the rule of Awami League, cases are going on in the names of former prime ministers and military and civilian security officials.

On November 6, the press secretary of the chief adviser, Shafiqul Alam, said that the advisory council approved the draft of the ordinance, keeping the maximum penalty for disappearance as death penalty. The ordinance was released Monday night.
