The writ seeking ban and cancellation of Awami League's registration is dismissed


The High Court has rejected the writ seeking to ban Awami League and cancel the party's registration.

The writ was dismissed outright during the hearing in the High Court bench of Justice AKM Asaduzzaman and Justice Muhammad Mahbub-ul Islam on Sunday.

Earlier on August 27, the Attorney General wanted to dismiss the writ filed in the High Court seeking to ban Bangladesh Awami League and cancel the party's registration due to indiscriminate killing of students during the quota reform movement. Asaduzzaman.

On that day, the Attorney General made such a request in the hearing on this application in the High Court bench. The court then adjourned the hearing till September 1.

At the hearing of this writ, Attorney General Md. Asaduzzaman told the High Court that the interim government has no intention to ban or cancel the registration of any political party. This government believes in the freedom of organization and political parties that is enshrined in the constitution. And the injustice of those involved in the previous authoritarian government will be tried through the courts of law. It is not appropriate to ban any political party for that.

Attorney General said, there are many good leaders and activists in Awami League, who believe in their ideals. So it is not the job of the court to ban their religious group. In the context of the slogan 'Who will judge you, the people have woken up', the new freedom that has come in the mass uprising of the students, freedom of speech and fundamental rights of all must be guaranteed. Therefore, the freedom to manage political parties cannot be stopped at this time.

The Attorney General also said, 'We have seen an attack on the Chief Justice's residence. Which none of us wanted. Such an outpouring of anger is in the context of the judiciary's patronage and injustice with past authoritarian regimes. As a lawyer of the Supreme Court, any attack on the Judiciary is a matter of bleeding heart. Therefore, it is not right to drag the politics of the field to the court by banning any political party. No other political party came to the court with this writ.

On that day, the Attorney General rejected the writ and told the High Court, 'Awami League against whom this writ has been filed, has not been biased in the writ and no notice has been given. This writ has no locus standi. This writ is not maintainable. So requesting Ritkari to cast.

In this writ, the part seeking a minimum term of 3 years for the interim government was 'not pressed' (not raised) on the day of the first hearing by the petitioner. At the hearing on that day, Attorney General Md. Asaduzzaman told the court, 'The interim government is in accordance with the constitution. How long they stay is not a matter brought up for court order. This issue of the writ is not maintainable.'

The writ was filed on August 19 by Arifur Rahman Murad Bhuiyan on behalf of human rights organization Sarda Society.
