Various discussions are going on regarding the cases related to the attack on the accused in the court premises and the murders that took place during the July-August anti-discrimination student movement. Chief advisor. The situation did not change even after Muhammad Yunus gave instructions in his address to the nation about the court attack and the case.
When former ministers and Fourteen Party leaders Hasanul Haque Inu and Rashed Khan Menon were produced before the CMM (Chief Metropolitan Magistrate) court in Dhaka on Tuesday, they were attacked.
The anger of the lawyers present and the public can be seen towards Jasad President Inu. They are seen throwing eggs, killing punches and kicks while being brought to court as accused in murder cases.
Inu was seen beating shoes even as the two were taken out of the court under heavy police guard after being granted remand in the first case.
Human rights activists consider it a matter of concern that the attacks and harassment did not stop even after the arrested accused were brought to the court under tight security.
Earlier, former judge AHM Shamsuddin Chowdhury Manik, after being detained at the border, was attacked when he was produced in the Sylhet court. He was seriously injured in the attack. When the court sent him to jail, he was sent to hospital from there. After surgery on the body, he has to be kept in the intensive care unit.
Besides, former captain of Bangladesh football team and deputy minister Arif Khan Joy and former minister Dipu Moni Adalet were subjected to bad harassment in the CMM court of Dhaka. Human rights activists feel that what is happening to the accused arrested by the court should be stopped with quick action.
Human rights activist Noor Khan Liton said, “It is not only a violation of human rights but I don't know how to describe it. The court is supposed to be a free space for people. When law enforcement forces present them in court, the incidents we see – killing, punching, shoeing followed by physical torture like what we saw with Justice Manik, Dipu Moni and then Joy, these incidents are not justifiable at all.” He said that we should be more careful so that these incidents do not happen again.
He also said, “It should be remembered that for a long time we were oppressed, we were facing torture. We couldn't talk. When we have got a life-saving condition today through the blood of the students, that place should not be allowed to be destroyed in any way. Inking should not be allowed.”
“Events happening in courtrooms and especially when lawyers are involved and some lawyers are preventing lawyers from standing up for the accused will but overshadow the victory that we have today.” It does not augur well abroad or at home in any way. As the common people of the country are not liking this, the international level will also question us about it.”
Meanwhile, after the speech of the chief counsel, it was seen that the activity of the army and the police increased before the accused were presented in the court. But in the meantime, attacks are going on. The police did not appear to take any action against the attackers or anyone involved in the attack.
Legal advisor in this regard. Asif Nazrul told BBC Bangla that the government does not support them. The advisor also informed about taking some strategies to stop these in the future.
“We do not support it in any way. You should also take this fact into consideration. Many people have anger, anger, anger. Now if I were to expect overnight that every human being would behave like Mahatma Gandhi, it would be too much, and it would be impossible to accept. We don't want it anyway, but we thought of some other ways to resolve it. You will see its implementation.”
Questions about the case
A case of Bangladeshi all-rounder cricketer and former MP Shakib Al Hasan is being widely debated on social media and in the public sphere. Shakib has been accused in the murder case of garment worker Mohammad Rubel. Shakib's name has been implicated in the case even though he was abroad at the time of the incident, raising questions about the process of the murder case.
Accused number 28 in that case at Adabar police station is Shakib. In that case, 156 people have been named and 4/5 hundred people have been made unknown accused. The plaintiff in the case, Rafiqul Islam, lives in Nilphamari.
The mobile number given in the statement of claim to contact the plaintiff is of a different person. The holder of the number assisted the plaintiff in filing the suit. The person with the number identified himself as an activist and a distant cousin of the victim. He told the BBC that the plaintiffs are not willing to comment on the case to the media.
There have already been more than half a hundred cases demanding justice for those killed in the student movement in Bangladesh. And more cases are being prepared. Meanwhile, an application has been filed in the court to initiate the murder case of Manik Mia, who was killed in Rangpur, where the plaintiff himself has claimed that he did not give the names of the accused.
In Rangpur court, a large number of unidentified accused have been named as 119 persons as plaintiffs in Manik Mia's murder case. The next hearing of the case will be held on September 2. Nurjahan Begum has been named as the plaintiff in the case. Regarding the application of this case, Manik Mia's family informed that they want to withdraw the names of hundreds of accused. They spoke to the student coordinators of Rangpur about the matter.
Manik Mia's mother Nurjahan Begum said that the signature of the case application has been taken from her.
“I have not mentioned the name of a single accused. I have not named a single person. I can't say what these lawyers are doing, father. Even though I did not want to sign, they took my signature. My son-in-law's name is given, my brother's name is given, my son-in-law's name is given.”
Lawyer Alauddin filed the case in court. He said that the lawyer of the plaintiff's case is changing.
On the question of how the names of the accused were given, he said, “There are plaintiffs in the case, there are witnesses, they gave it.” Do I have a ya here?”
193 people have been accused in the murder case of student Naeem Howladar under Jatrabari police station, including seven journalists. Plaintiff Kamrul Islam claimed on the telephone that he himself mentioned the names of these journalists.
He said, “There are journalists, do they have faults or not?” Don't have? ists are not all from the same party. There are different groups. Some write inflammatory speech, say inflammatory speech.”
Human rights activist Noor Khan Liton said that these cases will not survive in the washing.
“I don't know how Shakib Al Hasan has been added. And about the journalists but it can be said very clearly how it is possible! In one case, seven journalists were accused in the case. The way the accused are being charged and the way anonymous people are being talked about is just a repeat of the old litigation culture that we saw under the last government.”
Regarding the case, the legal advisor said some cases are embarrassing for them too.
“There can be many complaints against Shakib, people can have many sorrows about his various behavior but it is very difficult to accept the murder case. Now if someone files a case personally, you cannot legally prevent this under the laws of Bangladesh.”
Although there is an opportunity to exclude the accused after checking the cases, it is not possible due to the pressure, the legal advisor admitted.
“The local mob created so much pressure. Come to the police and say that this is how the case should be filed. This must be given. De fil insecure. And if you don't agree, you were the magistrate of the fascist government, the police of the fascist government. How are we going to stop the frenzied mobs in this place?”
Regarding trying to find a solution, the adviser said, “We are still trying to talk to the political parties to see if we can control it a little bit through them.” You don't think we like these situations. We don't like. We will try to resolve these two problems as much as we can.”
