Bangabandhu's family members security law is repealed


The 'Protection of the Family Members of the Father of the Nation Act 2009' enacted to protect the family members of Bangabandhu Sheikh Mujibur Rahman is being repealed.

It is known that the proposal to amend the law is being raised in the meeting of the advisory council. The Special Security Forces Act 2021, which ensures the same security to Bangabandhu's family members 'irrespective of their status' as VVIPs as the President and Prime Minister, will be amended.

If the proposal is approved, the Special Security Force (SSF) security facility, safe housing and other facilities required by the government for the safety of former Prime Minister Sheikh Hasina, her sister Sheikh Rehana, their children and their children's spouses and grandchildren will be cancelled.

After the formation of the Awami League government in 2009, the Family Members of the Father of the Nation Security Act 2009 was enacted to ensure lifelong special security for the two surviving daughters of Bangabandhu Sheikh Mujibur Rahman, former Prime Minister Sheikh Hasina and her younger sister Sheikh Rehana and their children. Under the Act, a 'Very Very Important Person' (VIP) is provided with the same type of security as the Special Security Force (SSF) provides for life. Besides, to ensure the safety of Bangabandhu's family members, there is an obligation to provide safe and secure housing and other necessary facilities for each member in this Act.

The Special Security Force Act was enacted in 2021 to ensure equal security for VVIPs like the President and family members of Bangabandhu anywhere. If any person poses a threat to the physical safety of these persons, the SSF members have the power to arrest him. If the person tries to evade arrest or resists the arrest attempt, the SSF may use lethal force or any other necessary means against him by giving proper warning. Under this Act, no case can be filed against the members of SSF without the prior approval of the Government.

Sheikh Hasina fled to India after resigning amid public outcry on August 5. Then a writ was filed in the High Court challenging the validity of these two laws.

Sections 2(b), 2(c), 8(1), 8(3), 8(4) and 9(2) of the 'Protection of Family Members of the Father of the Nation Act 2009' and the 'Special Security Forces Act 2021' in the writ; Writs have been filed to declare them unconstitutional and invalid where the family members of Father of the Nation Bangabandhu Sheikh Mujibur Rahman are written.

Law Secretary, Home Secretary, Finance Secretary, DG Special Security Forces and former Prime Minister Sheikh Hasina, Sheikh Rehana, Sheikh Hasina's son Sajib Wazed Joy, Sheikh Hasina's daughter Saima Wazed Putul, Sheikh Rehana's son Redwan Mujeeb Siddique Bobby and Sheikh Rehana's daughter Tulip Siddique And Azmina Siddique Rupanti has been made a defendant.
