Election Commission wants to suspend Awami League registration – Bangladesh Diplomat

The Election Commission (EC) is planning to suspend all activities and communications of the party with the Awami League registration and EC. That is why the Commission looks at the government's notification. The government is expected to issue an order on Monday. The EC plans to hold a meeting to decide on the matter. This information has been revealed in multiple sources.

Many election officials, who did not want to be named, said that if the political party was not banned after the registration system, it was the first case of prohibition of activities. The RPO has provision that the registration of the party will be canceled if the government banned a political party. If the party activities are banned, there is no clear provision in the law on whether the party will have registration. In such a situation, the Commission will take action according to the issues mentioned in the notification on the party's registration.

However, election experts said that all activities of the Awami League were prohibited for genocide in the July movement, the government had brought amendments to the International Crimes Tribunal Act and Anti -Terrorism Act. Now whether the party will register and whether the RPO will seek the amendment – the EC has to take action on all these issues. They said the EC would have to think about what would happen if the party leaders participated in the next parliamentary elections and campaigned in the next parliamentary elections with that opportunity.

When contacted, Brigadier General (retd) Dr. did not agree to comment as an adviser to the interim government. M Sakhawat Hossain. As a former Election Commissioner, he said the government has banned all the activities of the Awami League. How will the party that is banned, how will the registration of that party? For this reason, the Commission may make a decision independently on whether the amendment to the People's Representation Order (RPO) will be amended or whether any other action will be taken to keep up with other laws. This power is in the Commission. He also said that if the registration of the Awami League is upheld, the party will be given the opportunity to participate in the elections. With that opportunity, the EC has to think about what the EC will do if anyone has a candidate in the election.

Senior EC officials said that the registration of the political party is usually canceled in two ways. First, according to the law (RPO) and secondly, according to the court judgment. They said that according to an order of the High Court, the then Election Commission canceled the Jamaat -e -Islami registration on December 27. The EC took the action before the application was settled in the Appellate Division. The party has not yet regained registration as the legal battle is not over.

The officials said that the cancellation of the registration legally was mentioned in the RPO sub -section. It has been said that the EC will cancel the registration of that party if the government ban the government. They said the government did not cancel the Awami League registration, canceled all the activities of the party. There is no clear provision in the RPO in this regard. In this case, if the Awami League wants to cancel the registration, the RPO can propose amendments in line with the amendment of the Anti -Terrorism Act. Or the EC has the opportunity to take action according to the notification. In this case the registration of the party may be postponed. If that happens, the Awami League leaders will not have the opportunity to contest the boat symbol in the upcoming parliament and local government elections.

Asked about the Election Commissioner. Anwarul Islam Sarkar told Jugantar, “We will decide on how the government issues or notifications, what the conditions and contents will mention there.” “We hope the government's decision on Monday will be officially known,” he said. Then I will hold a meeting to decide. I can't say anything about this until I see the notification.

According to the existing RPO, Jasmine Tuli, a former Additional Secretary of the Election Commission and a member of the Election Commission Reform Commission, said there was no opportunity to cancel the registration of the Awami League. He said the EC could not cancel the registration as the Awami League was not banned as a party. However, since all the activities of the Awami League have been banned, there is an opportunity to suspend registration. He said that if the registration was postponed, the party would give candidates in the elections, allocate EC symbols for those candidates and get all the facilities such as providing voter list from the commission.
